Please read carefully before agreeing to this assumption of risk, waiver, and release from liability (“Agreement”). Every London Bridge Resort, LLC (“LBR”) Activity Participant (“Participant”) must read, agree to, and complete this form prior to participating in any LBR activities. All participants under the age of 18 must have signature of participant’s parent/guardian. AUTHORITY AND ACKNOWLEDGEMENT OF RISK: I hereby certify that I am the parent and/or legal guardian of the above-named child(ren) and that I have the authority to execute this Waiver and Release on behalf of myself and my child(ren) (the “Releasor”). Releasor acknowledges and understands the risks inherent, or to be anticipated, in participating in the Swim Race at London Bridge Resort (the “Activity”), such as bodily injury, including but not limited to drowning, swimmer’s ear, or athlete’s foot, property damage, or death. Releasor, being fully aware of such risks, requests that each child named above be allowed to participate in such Activity. Releasor further agrees, represents, and warrants that Releasor’s child is capable, in good health, and in proper physical condition to participate in such Activity. Releasor understands that there may be additional risks based on Releasor’s child’s physical condition and further agrees and warrants that if at any time Releasor believes conditions or circumstances to be unsafe, Releasor’s child will immediately discontinue participation. RELEASE/WAIVER: In consideration of each child named above being permitted to participate in the Activity, RELEASOR HEREBY COVENANTS NOT TO SUE AND FULLY RELEASES AND DISCHARGES LBR, ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, VOLUNTEERS, CONTRACTORS (THE “RELEASEES”) FOR ANY AND ALL LOSS OR DAMAGE AND FROM ANY AND ALL ACTION, SUIT, CLAIM, OR DEMAND OF ANY KIND, EITHER IN LAW OR EQUITY, ARISING FROM ANY INJURY TO THE PERSON OR PROPERTY OF, OR RESULTING IN THE DEATH OF, RELEASOR OR RELEASOR’S CHILD(REN) AS A RESULT OF RELEASOR’S CHILD(REN)’S PARTICIPATION IN THE ACTIVITY OR PRESENCE ON THE PREMISES. THIS WAIVER AND RELEASE IS ON BEHALF OF RELEASOR, AND RELEASOR’S CHILD(REN), HEIRS, PARENTS, ASSIGNS, AND PERSONAL REPRESENTATIVES. INDEMNITY: RELEASE HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS Releasees from any and all losses, liabilities, or claims (including reasonable attorneys’ fees and costs) that Releasees may incur due to presence of Releasor and his/her child(ren) on the premises or the participation of Releasor or any child(ren) name above in the Activity, whether caused by negligence of Releasees or otherwise. MEDICAL RELEASE: In the event that Releasor is unable to be reached at the contact information provided above, or otherwise as deemed necessary by LBR, RELEASOR HEREBY AUTHORIZES LBR, as Releasor’s agent, to seek medical treatment for Releasor’s child(ren) by a licensed physician or hospital, in the case of a medical emergency or when such treatment is deemed necessary by the physician. RELEASOR FURTHER AUTHORIZES LBR to administer first aid or CPR to Releasor’s child(ren). Releasor shall be responsible for all costs of necessary medical attention or treatment. RELEASOR further expressly agrees that the foregoing LIABILITY WAIVER AND RELEASE is intended to be as broad and inclusive as is permitted by the laws of the State of Arizona and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. EACH RELEASOR HAS CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTANDS TO ITS CONTENTS, AND IT IS AWARE THAT THIS IS A RELEASE OF LIABILITY AND CONTRACT BETWEEN THE PARTIES HERETO, AND EACH RELEASOR HAS SIGNED OF HIS/HER OWN FREE WILL.
